Welcome to Big South Performance. These Terms & Conditions govern your use of our website, communications with us through the website, and requests for automotive services.

By accessing or using this website, submitting a service request, contacting Big South Performance, or otherwise using the website, you agree to these Terms & Conditions.

These website terms do not replace any written estimate, repair order, work authorization, invoice, warranty document, or other agreement provided in connection with specific automotive services.

1. About Big South Performance

Big South Performance provides automotive repair, diagnostics, maintenance, performance upgrades, tuning, parts installation, and custom automotive services in Winston-Salem, North Carolina.

Certain services may depend on vehicle condition, compatibility, parts availability, software access, manufacturer requirements, project scope, and other technical factors.

Submitting a request through this website does not guarantee that Big South Performance can or will perform the requested service.

2. Website Use

This website is provided for general information, service inquiries, appointment requests, and communication with Big South Performance.

You agree not to:

  • Use the website for unlawful or fraudulent purposes.
  • Submit false, misleading, or incomplete information.
  • Attempt to interfere with the operation or security of the website.
  • Attempt to gain unauthorized access to the website, servers, forms, or related systems.
  • Copy, reproduce, or commercially exploit website content without permission.

We may modify, suspend, restrict, or discontinue any part of the website at any time.

3. Service Requests and Appointments

Submitting a contact form, service request, appointment request, email, or other inquiry does not create a confirmed appointment or service agreement.

After receiving your request, Big South Performance may review information such as:

  • Vehicle year, make, and model.
  • Engine or trim.
  • Vehicle condition.
  • Existing modifications.
  • Fault codes or warning lights.
  • Requested repairs or upgrades.
  • Compatibility requirements.
  • Photos, diagnostic information, or supporting documents.

An appointment is confirmed only after Big South Performance communicates acceptance and confirms the applicable date, time, and service requirements.

4. Estimates and Authorization

Pricing shown or discussed before inspection or diagnosis may be preliminary.

Final cost may depend on factors including:

  • Vehicle condition.
  • Diagnostic findings.
  • Parts availability.
  • Labor requirements.
  • Previous repairs or modifications.
  • Compatibility issues.
  • Additional components required to complete the work safely or correctly.

When required by applicable North Carolina law, Big South Performance will provide a written estimate and obtain appropriate authorization before performing covered repair work.

Additional work that materially changes the approved scope or price will require customer authorization when required by law.

Nothing in these Terms & Conditions is intended to waive any right that cannot legally be waived under the North Carolina Motor Vehicle Repair Act or other applicable law.

5. Diagnostic Services

Automotive diagnosis can involve inspection, testing, scanning, disassembly, software communication, road testing, or other procedures necessary to determine the condition of a vehicle.

A diagnostic service identifies available evidence and possible causes of a problem. It does not guarantee that every problem will be discovered during the initial inspection.

Some faults may be:

  • Intermittent.
  • Hidden.
  • Related to multiple systems.
  • Caused by previous repairs or modifications.
  • Impossible to reproduce during the initial inspection.

Diagnostic charges, where applicable, may be payable separately from repair charges.

If further testing, teardown, parts, or labor are necessary, Big South Performance may request additional authorization before continuing.

6. Customer Authorization

The customer is responsible for accurately describing known vehicle problems, modifications, previous repairs, warning lights, fault codes, and other information that may affect diagnosis or service.

By authorizing work, the customer confirms that they:

  • Own the vehicle or are authorized to approve work on it.
  • Have provided accurate information to the best of their knowledge.
  • Authorize Big South Performance to perform the agreed inspection, diagnosis, repair, installation, programming, tuning, or other approved services.

The specific scope of authorized work will be governed by the applicable estimate, repair order, work authorization, invoice, or written communication.

7. Performance Modifications and Custom Work

Performance upgrades and custom modifications can change the operation, characteristics, reliability, emissions behavior, drivability, fuel requirements, noise level, power output, handling, braking, or durability of a vehicle.

Services may include, where accepted by Big South Performance:

  • Performance parts installation.
  • ECU tuning or calibration.
  • Engine swaps.
  • LS swaps.
  • Custom engine builds.
  • Restomod work.
  • Turbocharger or supercharger installation.
  • Supporting fuel, cooling, exhaust, drivetrain, wiring, or electronic modifications.

No specific horsepower, torque, fuel economy, acceleration time, vehicle lifespan, or other performance result is guaranteed unless expressly stated in writing.

Results vary based on the complete vehicle configuration, condition, parts, calibration, fuel, environment, maintenance, and intended use.

8. ECU Tuning, Flash Programming, and Electronic Services

ECU tuning, programming, module flashing, and electronic configuration may depend on:

  • Vehicle make and model.
  • ECU or module type.
  • Current software version.
  • Hardware configuration.
  • Existing modifications.
  • Manufacturer security requirements.
  • Third-party software or licensing.
  • Communication and programming access.

Not every vehicle, ECU, or module is compatible with every requested service.

Software changes may also affect manufacturer settings, diagnostic behavior, emissions systems, drivetrain operation, or warranty coverage.

Customers are responsible for informing Big South Performance of existing tuning, aftermarket electronics, previous module programming, or other modifications before work begins.

9. Vehicle Compatibility

Big South Performance may inspect or research compatibility before installing parts or beginning a custom project.

Parts that appear compatible based on manufacturer or supplier information may still require modification, supporting components, additional labor, or further evaluation.

Big South Performance may decline to install or use a component if it determines that the component is incompatible, unsafe, unsuitable, damaged, incomplete, or inappropriate for the vehicle or intended use.

10. Customer-Supplied Parts

Big South Performance may choose whether to accept customer-supplied parts.

If customer-supplied parts are accepted, additional conditions may be stated before installation.

Unless otherwise agreed in writing, Big South Performance is not responsible for defects, incorrect fitment, missing components, manufacturer failures, or other problems inherent in parts supplied by the customer.

Additional labor caused by defective, incorrect, incomplete, or incompatible customer-supplied parts may result in additional charges if authorized.

11. Parts Availability and Project Timelines

Estimated completion dates are estimates unless expressly guaranteed in writing.

Completion may be affected by circumstances including:

  • Parts availability.
  • Shipping delays.
  • Supplier backorders.
  • Additional diagnostic findings.
  • Vehicle condition.
  • Previous modifications.
  • Fabrication requirements.
  • Software or programming access.
  • Customer approval delays.
  • Changes to project scope.

Big South Performance will make reasonable efforts to communicate significant changes affecting an approved project.

12. Payment

Customers are responsible for charges associated with work they authorize.

Payment requirements, deposits, payment schedules, accepted payment methods, and balances due will be communicated in connection with the applicable service or project.

Unless otherwise agreed in writing, payment for completed and authorized work is due according to the applicable invoice or repair order.

Taxes, shop supplies, diagnostic charges, parts, labor, third-party services, programming fees, or other authorized costs may apply where appropriate.

13. Vehicle Pickup and Storage

Customers should arrange to collect their vehicles promptly after being notified that authorized work has been completed.

If storage charges may apply, applicable charges and conditions will be disclosed as required by law or in the applicable repair documentation.

Nothing in these Terms limits rights or obligations arising under applicable North Carolina law regarding repaired vehicles, payment, storage, or possessory liens.

14. Replaced Parts

Customers may have rights under North Carolina law concerning inspection or return of replaced parts.

Requests to inspect or retain replaced parts should be made when repair work is authorized.

Certain parts may be subject to manufacturer warranty procedures, core-return programs, exchange requirements, environmental disposal requirements, or other restrictions that prevent their return.

15. Warranties

Any warranty applicable to parts or labor will be stated in the applicable invoice, repair order, manufacturer documentation, or separate written warranty.

Unless specifically stated in writing, information on this website should not be interpreted as creating a warranty regarding:

  • Vehicle performance.
  • Horsepower or torque.
  • Fuel economy.
  • Compatibility.
  • Manufacturer warranty coverage.
  • Vehicle lifespan.
  • Future component failure.
  • Fitness for racing, competition, or any particular purpose.

Manufacturer warranties on parts are subject to the manufacturer’s own terms and conditions.

Nothing in this section limits warranties or consumer rights that cannot legally be excluded.

16. Modified and Performance Vehicles

Modified vehicles may place additional stress on engines, transmissions, drivetrains, cooling systems, fuel systems, electrical systems, suspension components, brakes, tires, and other parts.

A failure occurring after a modification does not automatically mean that the modification or service caused the failure.

Likewise, installing or tuning one component does not guarantee the condition or reliability of unrelated or pre-existing components.

Big South Performance may recommend additional inspection, maintenance, supporting modifications, or repairs before or after performance work.

17. Street Use, Competition Use, and Legal Compliance

Vehicle owners are responsible for ensuring that their vehicles comply with applicable federal, state, and local laws and regulations.

Certain modifications may affect:

  • Emissions compliance.
  • Noise requirements.
  • Vehicle inspections.
  • Road legality.
  • Registration requirements.
  • Manufacturer warranties.
  • Insurance coverage.

Customers should verify the legality and suitability of any requested modification for their intended use.

Big South Performance may decline work that it determines cannot appropriately or legally be performed.

18. No Guarantee of Manufacturer Warranty Coverage

Aftermarket parts, tuning, programming, engine modifications, powertrain changes, or other alterations may affect manufacturer or third-party warranties.

Big South Performance does not control warranty decisions made by vehicle manufacturers, dealerships, parts manufacturers, insurance companies, or other third parties.

Customers should review applicable warranty terms before authorizing modifications.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
